This Privacy Policy explains how we collect, use, share, dispose of and protect the information that you may provide to us when using the Products and Service and the Application. If we require you to provide certain information during your use of the Products and Service and the Application, we guarantee that such information will be used strictly in accordance with the terms and conditions of this Privacy Policy and/or End-user License Agreement.
We have taken your needs into full consideration when setting out this Privacy Policy. It is very important that you fully understand our personal information handling practices, procedures and systems, and that you can control the information provided to us.
Your personal information includes any information associated directly with you or that could be used to identify you that is supplied to us in conjunction with your use or potential use of the Products and Service and the Application (“Personal Information”).

INFORMATION THAT WE COLLECT
In order for you to use the Products and Service and the Application, we may need to collect your Personal Information. Your rejection to provide such information may result in a failure to use the Products and Service and the Application.
We collect Personal Information and Non-Personal Information including:
l Account-related info: if you choose to open an account with the Application, we may collect information such as verification code, avatar and nickname; if you choose to sign in with your 3rd-party account, then we may collect your 3rd-party account information, including your account name and profile picture.
l Personal information: we may collect your personal information, including your age, gender, height and weight.
l Device information: we may collect information in relation with your device, including your device name, frame SN, warranty period, motor SN, motor version, console SN, console version, firmware version and Bluetooth MAC address.
l FTP value: we may collect your FTP value calculated by the questionnaire, and other information supplied to us, including your exercise frequency, exercise habit and goal.
l Cycling goal: we may collect the cycling goal that you set, including cycling duration, mileage and target energy consumption.
l Cycling data: we may collect your cadence, current power, speed, torque, mileage, duration, energy burned, ranking and times of cycling.
l Cycling course: if you choose to ride with our cycling courses, we may collect records of courses that you take, including course name, completeness, times joined, target power, target cadence and power curve.
l Feedbacks: we may collect your feedbacks to our questions, including your phone number and other contact details.
We may also collect certain information that does not identify you, such as your web page click, login status, current version, Bluetooth connection, cycling events and error message (“Anonymous Information”). We use Anonymous Information to improve the service we provide to you, and types and amount of Anonymous Information to be collected depend on how you use the Products and/or Service.
Please be noted that we will synchronize your Personal Information via Bluetooth to your mobile device (such as your cell phone). When doing this on Android operating system, we need to request location access permission. However, we will not collect your location.
HOW WE USE YOUR PERSONAL INFORMATION
We collect your Personal Information in order to provide the Products and/or Service and we will follow applicable laws when using it. You understand and agree that we may handle your Personal Information for the purpose indicated in this Privacy Policy and that we may disclose your Personal Information to our affiliates (in relation with communications, social media, technology and cloud service) and/or 3rd-party service providers(as defined below).
We may use your Personal Information for the following purposes:
1. Provide, handle, maintain, improve or develop our Products and/or service, including post-sale service and customer support and services provided through device or website.
2. Communicate with you with regard to your device, service or any normal enquiry (such as update, customer support enquiry and information/notice about our activities).
3. Analyze and develop certain statistics in relation with the use of the Products and Service, in order to make improvements.
4. Store and maintain information in relation with you, which will be used for our business operation and fulfillment of lawful obligation. The following explains with more details how we will use your information (including personal information).
l Sign-up and log-in: we will use your information to complete your registration and enable your log-in to the Application.
l Device connection and data sync: we may use the Bluetooth MAC address of your device for Bluetooth communication, thus to connect your device, synchronize information and accept commands of the Application. We may use your avatar uploaded by you or the avatar of your 3rd-party account for display in the ranking list of Route Ride.
l FTP test: we may use information you provide against our questionnaire to calculate your FTP value. The power zone chart helps you understand your exercise capacity.
l Real-time target power adjustment: we use your FTP value to tailor-make power training course for you, enabling you to train in a more scientific way.
l Record display: we use your cycling data for display by day, week or month, to give you a quick review of your exercise record. We collect your training course record, through which you can re-take the course by a quick click.
l Real-time advice: we may use your cycling data to generate cycling advice for you. For example, when your current power exceeds the required power, we will remind you to lower it down in order to achieve the best training effect.
l Exercise report generation: we may use your cycling data to generate an exercise report each time you finish training, and we will score your cycling in order to give you a clear view of your exercise quality.
l Firmware upgrade: we may use your device information in order to recommend the right firmware version.
l Notification: we may use your Personal Information for delivering notification, such as software version upgrade and modification of our terms, conditions and policies.
l Feedback: when you report to us any problems that incur to you during the use of our Products and Service, we may collect your contact information, problem content and logs to solve the problem and feedback to you.
Cookies or similar technologies (only when visiting www.nexgim.com)
Information that we collect and how we use it: NEXGIM and its 3rd-party service provider may also use cookies, tags or scripts etc. These technologies will be used for trend analysis, network management or tracking behavioral data of users.
Log files: we may collect and store in log files certain information including IP address, browser type, ISP, referring/exit pages, operating system, data/time stamps and click stream data. We will not link the data collected here to other information about you.
Advertising: In addition, certain third-party advertisers may also make use of cookies in their ads served within our Websites. Such cookies will collect behavioral data which those advertisers may use to serve you targeted ads both within and outside of our Websites. You can opt out of various targeted advertising we may use by emailing privacy@nexgim.com.
Mobile Analytics: we use Mobile analytics to help us understand how you use the Application. This software may collect information including your use frequency, activities taken within the Application, accumulative use, performance data and the location where the Application crash occurred. We will not link any information stored in this software to any of your Personal Information supplied to us.
Local storage-HTML5/Flash: we adopt Local Storage Object (LSO), such as HTML5 or Flash, to store contents and preferences. 3rd-party advertisers may also collect and store such information via HTML5 or Flash cookie, based on your webpage browsing behaviors. Different browsers may apply their own management tools to delete HTML5 local storage object.
HOW WE SHARE YOUR INFORMATION
Except as otherwise stated in this Privacy Policy, we will not sell, rent or transfer your Personal Information to third parties without your prior consent.
We may disclose your Personal Information to third parties and/or our corporate affiliates in order to provide the Products or Service that you require.
Under this circumstance, we will share your Personal Information only upon your authorization. Please be assured that when sharing your Personal Information with any third parties, we will make sure such third parties are obliged to follow applicable local data protection act. We will execute contracts with such third parties to make sure they comply with the privacy standards in your jurisdiction that shall apply to them.

To ensure full functionality of our Products and Service, we may, from time to time, disclose your Personal Information to our corporate affiliates and/or 3rd-party service providers, including our franchised stores, goods delivery suppliers, telecommunications companies, data centers, advertising partners and/or NEXGIM authorized agencies etc. The above-listed 3rd-party service providers may deal with your Personal Information on behalf of NEXGIM or for specific purposes. Data retention
We will maintain your Personal Information for as long as required or permitted by applicable laws or as long as necessary to achieve the purposes for which it is collected. We will not retain your Personal Information or will eliminate the method to associate your Personal Information with you, as long as it is reasonably concluded that the retention does not serve the purpose of collecting the information and that the retention is no longer required for legal settlement and enforcement of our agreement or other business purposes.
Access to other functions on your device
The Application may access to certain functions on your device, such as Wi-Fi status. We need such information to allow the Application to run on your device and allow the interaction between you and the Application. At any time, you may revoke your approval by closing the Application on your device or by contacting us at privacy@nexgim.com.

Control settings
We acknowledge that everyone has different concerns about privacy. Therefore, we provide various options for you to restrict our collection, use, disclosure or disposal of your Personal Information:
l Click My and then click on your nickname to edit your nickname, age, height and weight.
l Click MyàDevice Management to unbind your device.
l Click MyàFTP to redo the questionnaire in order to update your FTP value.
Though you may have agreed to our use of your Personal Information, you are entitled to change your decision by emailing privacy@nexgim.com.
Access, update or modify your Personal Information
You reserve the right to access and/or modify any of your Personal Information that we hold. When you request a modification of Personal Information, we may ask to verify your identification first. Once your identification is verified, we will handle your request within reasonable period of time.
Though under normal circumstance we provide data access service for free, we reserve the right to charge reasonable fees.
If you request access to your Personal Information held by us or, if any of your information held by us is believed to be incomplete or incorrect, please let us know by emailing privacy@nexgim.com.
Withdrawal of consent
You may send email to privacy@nexgim.com to withdraw your consent regarding our collection, usage and/or disclosure of your Personal Information supplied to us. We will deal with your withdrawal request within reasonable period of time.
Please note that your withdrawal of consent means that you are not able to use our Products and Service.
Transfer your Personal Information outside of your jurisdiction
We may need to transfer your Personal Information to our affiliates or 3rd-party service providers outside of your jurisdiction. We will do this only by keeping you fully informed and upon your authorization. And when doing this, we will comply with applicable laws and regulations.

CHILDREN
We do not knowingly collect or use any Personal Information from or send advertising materials of any type to children under the age of 18. To the extent that you believe your children under the age of 18 provided Personal Information to us without your prior consent, please feel free to contact us. We will remove such Personal Information collected.
Conflict of terms
If you’ve agreed to certain applicable End-user License Agreement, and if any provision contained in this Privacy Policy is in conflict with, or inconsistent with, any provision in the End-user License Agreement, the provision contained in the End-user License Agreement shall govern and control.
UPDATES
We reserve the right to change this Privacy Policy at any time. In the event we make material changes to this Privacy Policy, such policy will be re-posted in the "Privacy" section of our Websites/Apps with the date such modifications were made indicated on the top of the page. Therefore, please review this Privacy Policy from time to time so that you are aware when any changes are made to this Privacy Policy. Your continued use of the Products and Service after such change constitutes your acceptance of any such change(s), and if you do not accept any changes, you may choose not to use the Products and Service or opt out by sending us an appropriate notice.

Please note that the Products and Service may include other products and/or service supplied by other third parties or hyperlinks to other websites that are neither owned nor managed by us. NEXGIM is not associated with these third-party websites, products and/or service and does not review their privacy policies. We cannot guarantee the privacy of any information that may be obtained by third parties at these other websites, products and/or service. We suggest that you review the privacy policies of these third parties before supplying personally identifiable information.
